Divorce/Post Decree
A divorce decision and/or settlement, or a post decree modification can be achieved many different ways including negotiation, mediation, collaborative law or through going to court. Mediation is a process where the parties involved work together to reach a settlement of their issues with a third party neutral. Collaborative Law is a process where the clients work with attorneys and possibly other experts to reach a creative solution. Beckman and Steen works diligently to help their clients determine which process best suits their needs.
DIVORCE
During this emotionally trying time, you want confidence that your attorneys can find the solution you want. At Beckman & Steen we are here to help you make the best possible decisions. Our attorneys will listen to your concerns and explain to you each of your options, and work hard to achieve the best outcome.
Some of the decisions we will be facing together with you are:
•· Property Division - Property division includes all assets (retirement accounts, investments, real estate, and personal property) and all debts. Our divorce attorneys will work with you to create a proposal that will be acceptable to the court and to you and your family's needs.
•· Child Custody and Support - Child support is calculated based on the gross income of both parties and takes into consideration such expenses as day care and health care costs. These orders can be modified periodically if there is a substantial change in the circumstances or by seeking a cost-of-living adjustment. Our lawyers can help you secure the initial child support order, or modify an existing order.
•· Spousal Maintenance (Alimony) - We will help you to determine what circumstances in your case could justify whether spousal maintenance is appropriate based on the facts of your situation.
POST DECREE
As life changes so can court orders. Obtaining a modification of an existing court order will require a change in circumstances and at Beckman & Steen we are able to provide you with the guidance and knowledge to determine if a modification may be appropriate. Court orders can be modified for custody, paternity rights, parenting time (visitation), child support, and spousal maintenance (alimony).
